Suspect apprehended in Gary Martin shooting

John James Gwinn, 32, rural Waubun, Minn., was charged with second degree murder this morning (Monday) in the shooting death of a Wahpeton man, Gary Lee Martin, 29. Martin was shot to death about 7:15 p.m. Friday at Snider Lake about 12 miles east of Waubun. He was shot three times with a .22-caliber semi-automatic rifle and died enroute to the hospital according to local authorities.

A sheriff's spokesman said Gwinn was apprehended after he telephoned the Mahnomen County sheriff's office and asked that a lone deputy be dispatched to the house where he was staying. Authorities said Gwinn said he would surrender to the deputy when he arrived at the house.

The spokesman said sheriff's deputies surrounded the house, but Gwinn surrended to a single deputy who went to the door of the home, which was located in the area around Nay Tai Wausch in the central part of the White Earth Reservation.

Sheriff's officers from five counties and State Patrol troopers spent the weekend searching for Gwinn. They had tracked him into a swampy area Saturday night, but halted their search until daylight Sunday.

Gwinn was spotted early Sunday at a reservation powwow about 15 miles south of Mahnomen.

Mahnomen County Sheriff Verlyn Shersick said Gwinn had been staying in a cabin owned by Martin's father near Snider Lake. The victim was in an adjacent cabin also owned by Martin's father. Shersick said an argument reportedly ensued when Gwinn began chopping down a tree on the property.

The alleged murder weapon has not been recovered.

Funeral services for Martin will be Tuesday at 2 p.m. at the Vertin's Wahpeton Funeral Home Chapel, the Rev. Martin Cullen officiating. Burial will be in Fairview Cemetery.

Visitation will be Tuesday beginning at 9 a.m. and continuing until the time of the service at the funeral home.

He was born April 18, 1951 at White Earth, Minn., the son of James and Dorothy (Rogers) Martin. He later moved to Wahpeton with his family. He graduated from Wahpeton High School and attended the North Dakota State School of Science. He was employed as a construction worker.

He is survived by two brothers, Peter, Muskogee, Okla., and Richard, Minneapolis; and four sisters, Mrs. Gene (Bonnie) Walz, Lisbon, Mrs. Brian (Karen) Brant, Blaine, Minn., Mrs. Tony (Elaine) Salinas, Minneapolis, and Mrs. B.E. (Jeanette) Munson, Wahpeton.

He was preceded in death by his mother.
